This is a plain-English summary. The accepted Quote/Statement of Work (SOW) and our full Terms & Conditions govern the engagement.

Booking & Payments

  • Deposit to confirm: Filming dates are secured with a 50% deposit.

  • Holds (pencils): We operate first/second hold. If a second hold challenges, first hold has 24 hours to confirm and pay the deposit. Dates are not confirmed until the deposit is received.

  • Milestones & terms: 25% on completion of filming, 25% on final delivery. Standard invoice terms 30 days (plus VAT).

  • Late payment: Statutory interest may apply (UK Late Payment of Commercial Debts Act) 8% above BoE base rate + fixed compensation; we may suspend/withhold delivery until balances are settled.

Working Day, Half-Days & Overtime

  • Standard day: Up to 10 hours total, including travel, with a 1-hour lunch.

  • Overtime: 10–12h @ T1.5, 12–14h @ T2 (rounded up to the next hour).

  • Maximum day: >14h is charged as an additional full day; hotel required if working the next day.

  • Rest: Minimum 11-hour turnaround between working days.

  • Half-day: ≤5 hours incl travel (AM or PM). Labour typically ~75–80% of the full day. Equipment is usually 100% (prep/insurance/logistics are the same).

Travel, Overnights & Subsistence

  • Mileage: £0.45/mile from Lincoln; parking/tolls at cost.

  • Travel-only day: 75% of the operator day rate (equipment excluded). Partial travel may be charged at £45/hour.

  • Overnights: Accommodation at cost (single-occupancy rooms), plus £90/night working-away fee per crew member.

  • Meals/PDs (when not provided on site): Breakfast £10, Lunch £15, Dinner £25, Refreshments £5 (max £55/day per person).

Cancellation & Postponement

  • Deposit (50%) is non-refundable on client cancellation.

  • Additional fees per affected shoot day (crew + kit):

    • 15+ working days: no additional fee (deposit retained)

    • 10–14 working days: 25%

    • 5–9 working days: 50%

    • 2–4 working days: 75%

    • <48 hours / no-show: 100%

  • Postponement: With 15+ working days’ notice, one free re-date; deposit transfers to a new date within 60 days, subject to availability and like-for-like scope. Short-notice moves follow the bands above.

On-the-Day Disruption (Beyond Our Control)

  • If events outside anyone’s control prevent or pause production (e.g. venue power failure, evacuation, strikes, extreme weather), we’ll adapt where safe — re-sequence, relocate, record-only for streams, or use any pre-booked resilience (e.g. bonded 4G/5G or Starlink).

  • Waiting time counts toward the day and overtime. If disruption persists and delivery becomes impracticable, we may abandon and re-schedule per the cancellation/force-majeure terms.

  • Cost allocation follows the full T&Cs (venue/client-controlled issues are typically chargeable; genuine force majeure limits charges to time/costs incurred).

Deliverables, Footage & Rights

  • Deliverable: the completed edited film(s) in the agreed formats (e.g., H.264 MP4 and/or ProRes).

  • Amends: typically two consolidated rounds per deliverable.

  • Rushes/raw files: not included by default; can be supplied under a separate quote (prep time, media/hosting, licensing).

  • IP & licence: Bright Spark retains ownership of footage/project files. On full payment, the client receives a perpetual, worldwide licence to use the final deliverables for the agreed channels/purposes.

  • Data retention: We retain source media/project files for 90 days after final delivery; managed long-term archive available by arrangement.

Client Responsibilities

  • Provide timely access, parking/loading, power, and a suitable/quiet filming space; ensure permissions/releases are in place (we can supply templates).

  • Nominate a single point of contact to brief, review and approve; consolidated feedback helps keep schedules on track.

Insurance, Safety & Privacy

  • Public Liability & Professional Indemnity insurance in place (certificates available on request).

  • Health & safety: We may pause if conditions are unsafe or non-compliant; we’ll resume when safe.

  • GDPR: We process personal data only to deliver the agreed services and follow sensible retention practices. Event signage (“Filming in progress”) is recommended where appropriate.
