Key Terms (Summary)

This is a plain-English summary. The accepted Quote/Statement of Work (SOW) and our full Terms & Conditions govern the engagement.

Booking & Payments

Deposit to confirm
Production dates are secured with a 50% deposit.

Holds (pencils)
We operate a first/second hold system. If a second hold challenges, the first hold has 24 hours to confirm and pay the deposit. Dates are not confirmed until the deposit is received.

Milestones & terms
25% on completion of production, 25% on final delivery. Standard invoice terms are 30 days (plus VAT).

Late payment
Statutory interest may apply (UK Late Payment of Commercial Debts Act) at 8% above the Bank of England base rate plus fixed compensation. We may suspend or withhold delivery until balances are settled.

Working Day, Half-Days & Overtime

Standard production day
Up to 10 hours total, including travel, with a 1-hour lunch.

Overtime
10–12 hours @ T1.5
12–14 hours @ T2 (rounded up to the next hour)

Maximum day
Over 14 hours is charged as an additional full production day. Hotel accommodation is required if working the next day.

Rest periods
Minimum 11-hour turnaround between production days.

Half-day
Up to 5 hours including travel (AM or PM). Labour typically ~75–80% of the full day. Equipment is usually charged at 100%.

Travel, Overnights & Subsistence

Mileage
£0.60/mile from Lincoln. Parking and tolls charged at cost.

Travel-only day
75% of the operator production day rate (equipment excluded). Partial travel may be charged at £45/hour.

Overnights
Accommodation charged at cost (single occupancy), plus £90/night working-away fee per crew member.

Meals / subsistence (when not provided)
Breakfast £10
Lunch £15
Dinner £30
Refreshments £5
→ Maximum £60 per person per day

Cancellation & Postponement

The 50% deposit is non-refundable on client cancellation.

Additional fees per affected production day (crew and equipment):

  • 15+ working days: no additional fee (deposit retained)
  • 10–14 working days: 25%
  • 5–9 working days: 50%
  • 2–4 working days: 75%
  • Less than 48 hours / no-show: 100%

Postponement
With 15+ working days’ notice, one free re-date is offered. The deposit transfers to a new date within 60 days, subject to availability and like-for-like scope. Short-notice changes follow the same bands as cancellation.

On-the-Day Disruption (Beyond Our Control)

If events outside anyone’s control prevent or pause production (e.g. venue power failure, evacuation, transport disruption or severe weather), we will adapt where safe — including re-sequencing, relocating, switching to record-only, or using pre-booked resilience (e.g. bonded 4G/5G or Starlink).

Waiting time counts toward the production day and overtime.

If disruption persists and delivery becomes impracticable, the production day may be abandoned and rescheduled in line with cancellation or force majeure terms.

Cost allocation follows the full Terms & Conditions (venue/client-controlled issues are typically chargeable; genuine force majeure limits charges to time and costs incurred).

Deliverables, Footage & Rights

Deliverables
The completed edited film(s) supplied in agreed formats (e.g. H.264 MP4 and/or ProRes).

Amends
Typically two consolidated rounds per deliverable.

Rushes / raw files
Not included by default. Can be supplied under a separate quote (including preparation time, media/hosting and licensing considerations).

IP & licence
Bright Spark retains ownership of all footage and project files. Upon full payment, the client receives a perpetual, worldwide licence to use the final deliverables for the agreed purposes and channels.

Data retention
Source media and project files are retained for 90 days after final delivery. Managed long-term archive is available by arrangement.

Client Responsibilities

Provide timely access, parking/loading, power, and a suitable filming environment. Ensure permissions and contributor releases are in place (we can supply templates).

Nominate a single point of contact to brief, review and approve. Consolidated feedback helps keep projects on schedule.

Insurance, Safety & Privacy

Insurance
Public Liability and Professional Indemnity insurance in place (certificates available on request).

Health & Safety
We may pause work if conditions are unsafe or non-compliant, and resume once safe.

GDPR & privacy
We process personal data only to deliver agreed services and follow appropriate retention practices. “Filming in progress” signage is recommended where applicable.
